Cork court delays decision on screwdriver assault jurisdiction pending medical review

A Cork judge has put off deciding whether an alleged domestic assault involving a screwdriver can remain at district court level until he receives documentation on the complainant's injuries.

The matter came before a closed hearing at Cork District Court, where the defendant — a 49-year-old male — faces accusations of harming his former girlfriend and violating a protection order issued under domestic violence legislation. The parties were not identified in open proceedings.

The man had earlier been denied bail when the accusations were first presented. Prosecutors say that on the morning of April 8, officers responded to a call around 10:20am regarding a disturbance at a residence. The woman told investigators that her one-time partner showed up asking for his debit card. She stepped outside to talk, and he then allegedly pulled out a compact screwdriver with a dark grip and struck her upper left limb.

The injury was described as a laceration, though the victim reportedly did not seek hospital care at that time.

Justice David Waters stated he needed to review a physician's findings on the extent of harm before agreeing to keep the prosecution within the district court's remit. The hearing was pushed back to July 16 to allow for submission of that paperwork.
