A 14-year-old boy's father is pressing for the removal from the United States of the Colombian national who attacked his son in an East Harlem convenience store restroom, especially after the offender negotiated what the family considers an extremely mild punishment.

Nicol Alexandra Contreras-Suarez, aged 31, confessed to second-degree sexual assault in March and was handed a half-year custodial sentence. Prosecutors structured the agreement with the family's cooperation so the harmed adolescent would not be forced to appear as a witness during proceedings, the New York Post reported.

"The defendant is an immigrant from Colombia, came to the United States, and chose to commit this crime of rape," the victim's father declared. "I am hoping and praying that the defendant is deported back to the defendant's country and not allowed back into the United State due to this crime."

The young survivor also spoke before the judge. "I am ready to formally state that I want the defendant gone," he said. "What happened was deeply upsetting, and I do not wish to speak about the situation in detail, because I am trying to move forward with my life."

Border agents had previously taken Contreras-Suarez into custody at the southern frontier in March 2023 but subsequently released him into the interior. The attack took place on February 11, 2025, near Thomas Jefferson Park.

Now that the New York matter is closed, authorities are transferring the perpetrator to Medford, Massachusetts, where he must answer to unrelated accusations involving armed theft, offenses connected to commercial sex, and physical attacks. Federal immigration agents lodged a hold on Contreras-Suarez following the New York apprehension.

The Department of Homeland Security issued a harsh condemnation of the Manhattan plea arrangement in March, calling it "a gross miscarriage of justice."

As conditions of punishment, Contreras-Suarez must enroll in the sex offender registry at level two and complete a decade of supervised release. Representatives from the Manhattan prosecutor's office stated that matters concerning detention and expulsion fall under federal, not local, jurisdiction.
