A man is in critical condition after an off-duty Kingston police officer shot him during a road rage confrontation in Wawayanda, Orange County. No charges have been filed as state police investigate.

A 31-year-old man is in critical but stable condition after being shot twice by an off-duty police officer during a road rage confrontation in Wawayanda, Orange County, abc7ny.com reports. The incident occurred Thursday at approximately 3:45 p.m. on Dolsontown Road near McVeigh Road.

According to authorities, the altercation began when Wallace Fisher, the driver of a Volkswagen, exited his vehicle and approached the driver of a Toyota. The dispute at the driver's side window turned physical when Fisher allegedly produced a knife and swung it toward the inside of the car.

The Toyota's driver, identified as 33-year-old Anthony Simon, an off-duty Kingston Police Department officer, then discharged his firearm, striking Fisher twice — once in the neck and once in the shoulder.

Eyewitness Rob Parker, who recorded cellphone video of the confrontation, described the moment the shots were fired. "The boy swing, he punched him and immediately three shots went off," Parker said.

Parker told reporters the confrontation had its roots in a car wash exit, where one driver cut off the other. He described a chain of aggressive maneuvers that followed — tailgating, brake-checking, and one vehicle crossing into oncoming lanes to block the other from passing.

"When he got out the car, he could have left," Parker said. "I feel like the whole thing could have been avoided. On both parties, I feel like they were wrong."

Fisher was transported to Westchester Medical Center, where he was listed in critical but stable condition. No charges have been filed against either party as of the time of reporting. State police are continuing their investigation, reviewing video footage and interviewing witnesses.

The Kingston Police Department confirmed that Simon has been employed by the department since 2022. He has been placed on administrative duty pending the outcome of the investigation.
