Google News MT — Crime (en) reports that San Diego Police Department Officer Johnathan Penuelas discharged his service weapon at approximately 9:45 a.m. Tuesday while pursuing 44-year-old Judah Starr McBreairty on foot through a brushy area off the 4800 block of Pacific Highway, near the San Diego River in Mission Valley — just north of Interstate 8 and a short distance east of Interstate 5.
Penuelas, a three-year member of the SDPD, fired during the chase but no injuries resulted from the gunfire, according to the department.
McBreairty, who was the subject of an outstanding arrest warrant, continued fleeing after the shots were fired and managed to elude responding officers. Lt. Aloha Peters of the San Diego County Sheriff's Office confirmed the sequence of events. The Sheriff's Office investigates shootings involving SDPD personnel under a regional agreement designed to prevent conflicts of interest.
Officers searched for McBreairty through the remainder of the morning and into the evening hours. He was eventually located in the riverbed area and taken into custody with the assistance of a police service dog.
McBreairty sustained injuries during the canine apprehension and was treated before being booked into San Diego Central Jail on suspicion of violating the terms of his parole.
Authorities have not yet disclosed further details about the specific circumstances that led Penuelas to open fire.
