Prosecutors in New York have decided not to pursue rape charges against film producer Harvey Weinstein in connection with allegations made by an actress who claims he assaulted her at a hotel in 2013.

The case has now been dropped for the fourth time. The actress informed authorities that she was not able to testify again after previous trials were declared mistrials.

Weinstein was first convicted in 2020, but that verdict was overturned on appeal in 2023. A retrial was scheduled, but proceedings were halted in May when the jury could not reach a unanimous decision.

The prosecutor announced on Thursday that Weinstein will not be brought to trial again on this specific rape allegation. The actress had already testified three times in earlier proceedings.

However, prosecutors are continuing to pursue a separate sexual assault case involving a different woman. They are seeking a 20-year prison sentence in that matter. Sentencing in that case had been postponed until the proceedings involving the actress were concluded.
