A physician in Dominica facing charges of attempted murder and a firearms offense has secured release from custody after a higher court dismissed the prosecution's challenge to his bail.

A physician in Dominica who is accused of trying to kill a woman and firing a weapon near a public road has been freed from custody after a judicial panel rejected an appeal filed by state attorneys.

Dr. Theodore Thomas had earlier been offered conditional release by Senior Magistrate Michael Laudat on a bond of EC$75,000. Prosecutors quickly lodged an objection, forcing the medic back into detention at Dominica State Prison while the challenge was reviewed.

On Monday, the High Court threw out the state's appeal. Defense lawyer Wayne Norde argued that officials had failed to serve the paperwork correctly, and the presiding jurist accepted that position, letting the original release order stand.

Speaking afterward, Norde expressed satisfaction with the result, as reported by The St Kitts Nevis Observer. He declined to address the substance of the accusations, noting that litigation is still underway, and urged observers to allow the process to unfold without outside pressure.

The accused maintains he did nothing wrong and intends to contest the claims when the matter is heard, Norde added.

The release terms require the suspect to stay under the court's authority, check in with officers in Roseau every Monday and Friday, give up all passports and travel papers, steer clear of the complainant and anyone who may testify, and seek written consent before exiting the island.

He must return before the bench on March 30, 2026.

In January, the doctor denied attempting to murder Athena Dodds and also rejected the allegation that he fired a gun within 50 feet of a public road. Because the more serious accusation is an indictable offense, it will be handled by the High Court and no plea was taken on that count at the lower level.
