The defence of former player Robinho filed a petition with the Supreme Court of Justice seeking to remove the classification of heinous crime from the rape conviction he is serving in Brazil, according to migalhas.com.br.
In a petition presented to the Supreme Court on Monday, 1st, the lawyers argue that the Superior Court of Justice exceeded the limits of the foreign sentence by applying the consequences provided for in the law on heinous crimes.
Robinho has been imprisoned since March 2024, after the Supreme Court approved the enforcement in Brazilian territory of the nine-year prison sentence imposed by Italian justice. The conviction stems from the former athlete's involvement in the gang rape of a woman at a nightclub in Milan in 2013.
The defence counsels maintain that Italian legislation does not provide for the classification of rape as a heinous crime and that for this reason, the serving of the sentence in Brazil should comply exclusively with the terms set by Italian justice.
"The defence thesis does not seek privilege, impunity or undue beneficial treatment, but only fidelity to the foreign ruling, so that the appellant serves in Brazil exactly the sentence imposed by Italian justice, neither more nor less," states an excerpt from the petition.
The habeas corpus has been pending at the Supreme Court since November of last year and is under the relatorship of Justice Luiz Fux. To date, there is no scheduled date for judgement of the petition.
