The criminal court of Toulouse delivered its verdict in the case of a 46-year-old homeless man who had stolen a kitchen utensil from an establishment in the city centre. The individual received a sentence of eighteen months, comprising ten months in custody and eight months suspended with probation. Furthermore, he is now banned from entering the area where he committed his offences.
The facts date back to mid-June at a Toulouse brasserie called "Péry". The defendant, hungry, took a knife from a table. The proprietor of the establishment then restrained him by grabbing his upper limbs. Under the influence of illicit substances, the accused struck the owner twice.
During the hearing, the defendant admitted to all the facts with which he was charged. Before the judge presiding over the proceedings, Noël Picco, he acknowledged having consumed four grams of cocaine, which caused him to lose control. When asked about his future prospects, the man expressed profound distress, stating that he had neither family nor plans.
The public prosecutor had requested a sentence of one year in custody with immediate incarceration, referring to an individual with a serious criminal record who regularly disturbs those around him and can be aggressive.
For her part, his defence counsel, Me Audrey Liebert, pleaded by highlighting her client's social distress. The lawyer emphasised the accused's deteriorated physical condition, notably mentioning the extreme thinness of his legs and the multiple scars marking them, in an attempt to explain the desperate act of stealing for food.
The court ultimately exceeded the prosecution's request by imposing eighteen months. The judge closed the proceedings by expressing the hope that this conviction would allow the man to recover.
