Sudbury murder trial: Jamaican-born resident faces 12 charges over fatal 2023 shooting
The judge-and-jury trial of David Pusey, 30, opened Wednesday in Sudbury, Ontario, thesudburystar.com reports. Pusey, who is in custody, faces 12 charges including second-degree murder in the shooting death of Andrew Mackey, 24, on August 5, 2023.
According to Greater Sudbury Police, Mackey was pronounced dead after being rushed to hospital following a verbal altercation at a social gathering on Louis Street that escalated into violence in the early morning hours. Officers responded to a weapons complaint at around 6:45 a.m. and located two men on Notre Dame Avenue matching descriptions of those believed to be involved. Both were arrested without incident.
A search of the two men — one of whom was Pusey — turned up what officers believed to be the firearm used in the shooting. Alongside second-degree murder, Pusey's charges include unauthorized possession of a firearm, possession of a weapon dangerous to the public peace, pointing a firearm, careless use of a firearm, discharging a firearm with intent, breach of a release order, and breaching a weapons prohibition order. He was also wanted on an outstanding warrant for obstructing police and breaching a release order in connection with a 2022 incident.
Pusey, who holds permanent resident status in Canada, arrived from Jamaica in 2011 and formerly worked as a welder. He has a decade-long criminal history, mostly in Sudbury, and successfully challenged a deportation order despite that record. Last year, he received a four-year sentence for possessing a loaded .22 rifle found by officers at his Sudbury home on April 25, 2020. Police had searched the property acting on wiretap information indicating that Pusey "had been urgently trying to obtain a firearm." The weapon was discovered concealed in a bag of yard waste in the backyard.
