The Provincial People's Court of Havana imposed a sentence of fifteen years imprisonment on José Alberto Ducá Valón on 22 September, finding him guilty of the crime of trafficking in illicit substances. The Chamber for Crimes Against State Security, acting in criminal proceedings, also imposed additional sanctions including a prohibition on leaving Cuban territory and the confiscation of property linked to the criminal activity.
During the oral trial, evidence demonstrated that from August 2024 the accused had been engaged in transporting narcotics from the eastern province of Santiago de Cuba for sale in the capital. The products he distributed were cocaine and synthetic cannabinoid, offered in small packages at prices of 14,000 pesos per gramme for the first substance, and 4,000 pesos per gramme for the second.
On 12 September 2024, when attempting to return to Santiago de Cuba, members of the Anti-Drug Enforcement Body intercepted him. At that time, five packages containing a net weight of 3.38 grammes of synthetic cannabinoid were seized from him, along with a digital scale and a quantity of marijuana.
Throughout the investigative process and during the public hearing, the accused was afforded the procedural guarantees established by current criminal legislation. He exercised his right to legal defence and was assisted by a court-appointed lawyer, as he had not retained a private attorney.
The judicial ruling may be challenged through cassation appeal by either the condemned person or the prosecutor. This appeal shall be resolved by the competent Chamber of the Supreme People's Court.
