A court ruling issued in Rhode Island led to the release of Bryan Rafael Gómez, a Caribbean national whom American authorities are now seeking in connection with a homicide that occurred on the island. Magistrate Melissa DuBose had ordered his release, but one week later she reversed her decision and allowed the immigration enforcement agency to arrest him again.
The problem arose because, at the time of the first ruling, the court did not have information that the individual was being investigated for a crime committed on Dominican soil. Federal prosecutors acknowledged this omission in documents subsequently presented to the court.
As of the latest case file update, the defendant had not turned himself in to authorities. His legal representative had promised that he would voluntarily appear at the immigration service facilities in Boston, but has not done so to date.
