ANAF's anti-fraud division has identified a complex tax evasion mechanism in a security company, with an estimated loss of over 15.43 million lei.

Inspectors from the General Directorate of Tax Anti-Fraud (DGAF), within the National Tax Administration Agency, have discovered a complex tax evasion mechanism following national inspections in the security and protection services sector, according to radioresita.ro. The estimated loss exceeds 15.43 million lei, a sum which affected both the state budget and the social rights of employees.
According to the investigation, the company under scrutiny declared through form D112 a significantly lower number of hours worked compared to actual activity. DGAF analysis established that approximately 350,000 hours of work were not declared, and the corresponding social contributions were not paid. This practice directly affected employees' rights regarding pensions, health insurance and other social benefits.
To artificially reduce tax obligations, the company would have used a network of companies controlled by the same individuals, through which invoices were issued for services without genuine economic content. The stated purpose of the scheme was to reduce VAT and corporate income tax owed to the state. Although the number of employees grew rapidly, reaching approximately 250 people, the level of taxes declared and paid remained well below the level of actual activity.
During the investigation, ANAF inspectors identified substantial sums received from commercial activity, followed by large cash withdrawals from ATMs. Part of the funds would have been used for personal purposes, but also for payment of income not recorded in accounting records. Representatives of the company attempted to delay the inspection, but anti-fraud inspectors succeeded in reconstructing the actual economic activity based on data from ANAF databases, including through the RO e-Factura system.
All findings will be forwarded to the competent criminal investigation authorities, with a view to recovering the loss and holding the persons involved accountable. ANAF emphasises that failure to pay social contributions has direct effects on employees, affecting their right to pensions and medical services. The institution encourages employees to regularly verify that their employers are meeting their legal obligations.
