Judicial turn in the Callejero Fino case: house arrest and reduced charges

One month after his detention for illegal possession of a firearm with obliterated serial numbers, the legal situation of urban singer Callejero Fino underwent a significant change, according to mdzol.com.

The judge on the case upheld the preventive detention requested by the public prosecution but ruled to grant the musician the benefit of house arrest in the form of electronic ankle monitoring. The ruling also stipulates that, should there be delays in delivering the device due to lack of supplies in Buenos Aires province, the artist shall be transferred to his residence under permanent police custody until the monitoring system becomes operational.

Charge reframing, minimum sentence reduced by half

The progress does not stop at the change in detention conditions. Defence lawyer Diego Storto succeeded in having the court accept a modification of the legal classification of the offence: from unlawful carrying of a weapon to simple possession. The central argument of the defence was that the firearm was located inside the vehicle, not within the musician's immediate reach nor being held by him, and that no specific purpose for its possession was established.

The reduction has direct consequences on the penal scale: the legal minimum drops from four years of effective imprisonment to two years, which makes the offence potentially eligible for release.

The measure became executable after prosecutor Iribarren signed the resolution agreed between the parties. With the approval of the Public Prosecution Service and the defence, the proceedings advanced to carry out the musician's release from the penitentiary establishment and his subsequent transfer to the designated residence.

Removal from the "Tranzas" series

Despite the procedural relief, weeks of detention had consequences for the artist's career. It emerged that Callejero Fino was dropped from the leading role he was to have in the fictional series Tranzas, produced for a streaming platform, as the production could not postpone the start of filming.
