According to diariojornada.com.ar, Fabián Sampietro — currently held at Penitentiary Unit No. 6 in Rawson — faces multiple criminal cases: one for document falsification in Buenos Aires, another for aggravated homicide against Mario Giannóbile in Rawson, and a third pending in Trelew for attempted sexual abuse with penetration.
The Trelew case stems from an incident that occurred on 29 May 2025 at a residential address in that city. The accusation was filed with the classification of attempted sexual abuse with penetration, as perpetrator, in a context of gender-based violence and under the framework of Law 26.485 to prevent, punish and eradicate violence against women, as well as the international block of applicable conventions, according to a statement from the Public Prosecutor's Office.
Sampietro was arrested in Buenos Aires in December 2025, after a warrant for his arrest was issued following his declaration of contempt. In that city he is currently serving a sentence of three years and eight months imprisonment. For the Rawson incident, he is additionally serving preventive detention whilst the proceedings continue.
At a preventive detention review hearing, the Public Prosecutor's Office was represented by chief prosecutor Claudia Ibáñez, who outlined the defendant's procedural situation and argued that the risk of flight persists. The official requested that Sampietro remain under current detention conditions.
Judges Gustavo Castro and Mirta Moreno evaluated the Prosecution's arguments and noted that the Defence lodged no objection in this regard. Consequently, they resolved to maintain preventive detention until the preliminary hearing in the Trelew case takes place.
For that stage, referral to jury trial has been requested. Should the court find him guilty, the applicable sentence would exceed three years imprisonment.
