TikToker sentenced to 16 years in prison for killing mother and daughter in Rosario

Rosario TikToker receives 16 years in prison for homicide following high-speed pursuit
The TikToker Agustín López Gagliasso, 22 years old, was sentenced to 16 years in prison for the crimes of simple homicide with eventual intent and minor injuries, according to tiempodesanjuan.com. The court also imposed a 10-year driving ban.
The ruling was handed down on Tuesday in courtroom 4 of the Rosario Criminal Justice Centre by First Instance judges Silvana Lamas Gonzalez, Valeria Pedrana and Paula Álvarez, more than a year after the incident.
The accident
The incident occurred on 21 January 2025 at the intersection of Avenida Arturo Illia and Presidente Roca in Rosario. Gagliasso was driving his Peugeot 206 through the Avenida Illia tunnel when, following a disagreement with a motorcyclist, he initiated a pursuit. According to the prosecution's reconstruction, he accelerated to 120.7 kilometres per hour, double the speed limit for that stretch.
Upon reaching the intersection, the defendant did not brake and performed zigzag overtaking manoeuvres between other vehicles. He lost control of the Peugeot, skidded, mounted the pavement and crashed into a group of people standing next to a traffic light pole.
Tania Gandolfi, 41 years old, and her daughter Agustina García, 17, died instantly. A six-year-old girl, a 45-year-old man and a 20-year-old woman who was travelling in the Peugeot sustained minor injuries.
The evidence and key testimony
The trial began on Monday, 7 September. Prosecutor Valeria Piazza, from the Specialist Fiscal Unit for Road Accidents and Negligent Crimes, presented videos and testimonies as central evidence. Among these, the account of the young woman travelling in the same vehicle proved decisive.
"I was blinded. I was afraid, I thought I was going to die. I held on tight. I didn't feel the impact. I got out of the car alone, I saw myself covered in blood. Everything hurt. At first I couldn't walk, I had glass stuck to my face. I asked for help. Agustín was always focused on chasing the motorbike. He was in his own world, he didn't care about anything, not whether I was dying or whether he was crashing into other cars. He was reckless," the witness declared.
The legal classification: eventual intent
Both the prosecution and the defence had requested a sentence of 18 years in prison—below the maximum of 25 years provided for in the Penal Code—and 10 years of driving ban. Both parties agreed that Gagliasso acted with eventual intent.
"The convicted party represented the result as a serious possibility, without this implying abandoning or renouncing such an unusually dangerous action for the lives of people and his own," the prosecution stated.
The lawyer for the victims' family characterised the requested sentence as "reasonable", given that this involves "such a young boy with no prior criminal record in this type of offence". He added that these elements "warranted a sentence in keeping with what we requested, which is even higher than those that have been requested in other cases with the same legal classification".
The sentence
The court ruled to sentence Gagliasso to 16 years in prison and a 10-year driving ban for the crimes of simple homicide with eventual intent regarding Gandolfi and García, plus minor injuries with eventual intent with respect to the other injured parties. The prosecutor clarified after the hearing that the grounds for the ruling would be disclosed within the next 10 days.
Gagliasso must serve his sentence at Penitentiary Unit No. 11 in Piñero.
