Before the Innsbruck regional court on Friday, a 33-year-old construction worker from Tyrol was convicted of Nazi revival offences and sentenced to a fine. Half of the €6,000 fine was suspended. The judgement can still be appealed.
The incident occurred in August 2024 in a club in the Tyrolean state capital. Around midnight, during the final song, the defendant raised his arm in the banned salute. A blood alcohol test showed a reading of 2.7 per mille. An expert assessor concluded that the man was largely not responsible for his actions.
The prosecution initially also accused the Tyrolean of xenophobic shouting. However, during the trial it emerged that the remarks had been made by another person. The doorman corrected his earlier statement: the defendant had raised his arm, but the slogans had been shouted by another guest. The investigating authorities are now searching for this additional suspect.
Presiding judge Helga Moser emphasised in her ruling that such behaviour must not under any circumstances be trivialised. The convicted man admitted that he could no longer remember details, but denied holding xenophobic views.
As the man was heavily intoxicated at the time of the offence, the case was tried before a single judge rather than a jury court. Source: Kronen Zeitung
