Prosecutor Luis Whaner Montaño Morales was arrested on Saturday at the facilities of the Specialised Department Against Corruption (Delcc), according to confirmation from El Deber. The investigation against him focuses on the alleged crime of usurpation of functions.

Montaño presented himself voluntarily to police facilities. The prosecutor assigned to the case, Milenka Roda, confirmed his detention: "I have been informed through a direct action report that this morning Dr. Luis Whaner Montaño Morales presented himself voluntarily to the Delcc facilities, where he was arrested."

The case originated on 1 October, when Montaño publicly proclaimed himself the new Attorney General of the State, days after the apprehension of the head of that institution, Róger Mariaca.

Roda clarified that, before determining the legal status of the person under investigation, she will review the background of the direct action report and verify whether Montaño has a defence lawyer, in order to proceed in accordance with current regulations. Among the possible measures is a formal arrest warrant.

At the time this information was finalised, Montaño remained at police facilities pending determination of his legal status.
