The retired military police officer Emiliano Melo dos Santos, aged 103, was convicted on Thursday (24th) of the murder of a man that occurred in August 2021 in the Dois de Julho neighbourhood in Salvador. According to cnnbrasil.com.br, the defendant was 98 years old at the time of the events.
According to the TJBA (Bahia State Court of Justice), Emiliano witnessed an argument between a couple near his residence. Upon becoming involved in the situation, he fired shots that killed the man and wounded a woman.
The jury accepted the Public Ministry's thesis of qualified homicide, citing a factor that prevented the victim's defence, and rejected the claim of self-defence presented by the defence. The accusation of culpable bodily harm against the woman was declared time-barred.
Emiliano received a sentence of 4 years, 10 months and 19 days in semi-open regime imprisonment. Due to his advanced age and critical state of health, he will serve the sentence under humanitarian home confinement.
This was the second trial of the case. The trial reached the Jury Court in July 2023, but Emiliano was acquitted in November that year. The Public Ministry appealed and the Bahia Court of Justice ordered a new jury trial.
The new trial took place at the Ruy Barbosa Forum, where eight witnesses were heard — three for the prosecution and five for the defence — in addition to the defendant's interrogation.
