Weapon discharge during car theft attempt results in arrest in Jardim Palermo

A man was arrested on the morning of Thursday (15) after firing a weapon during a fight with a 15-year-old adolescent who was attempting to steal his car in Jardim Palermo, in Franca, in the interior of São Paulo. The case was registered at the local Judicial Police Station (CPJ) and will be investigated by the Civil Police, according to information obtained by g1.globo.com.

According to the Military Police (PM), the man heard his vehicle being started and left his house. Security camera footage recorded the moment when the two engaged in physical combat. During the confrontation, a shot was fired.

Military police officers entered the man's residence and found two further undocumented weapons, according to the Civil Police. He was charged in flagrante for firing a weapon in a public place and for illegal possession of a firearm. Payment of a bail of approximately R$ 1,630 would have allowed him to respond to the case whilst free. Until the report went to press, there was no confirmation that the amount had been paid.

To delegate Djalma Batista, responsible for the flagrante arrest, the man stated that he fired only to make the adolescent flee and to prevent the car from being taken. "As far as can be determined, he did not leave armed. Subsequently, he took possession of that weapon," declared Batista.

The man further informed that one of the weapons has an old registration, the validity of which will be verified by the Federal Police (PF). The other two, according to him, were inherited from his father and have no documentation.

The delegate reported that the two physically assaulted each other and that the man was injured on the forehead. Preliminary indications are that the adolescent has no police record.

The adolescent was charged with an infraction analogous to attempted improper theft and will be remanded to the Court of Children and Youth. The classification as improper theft — rather than theft — resulted from the violence employed by the young man at the moment he attempted to flee, as explained by Batista. Improper theft occurs when there is violence or threat following the attempted taking of an asset, with the objective of guaranteeing escape or possession of the object.

The details of the case are to be clarified in the police inquiry, according to the delegate.
