The basis is the indictment from the public prosecutor's office, according to which the officer knowingly used unjustified force and wilfully accepted the victim's suffering.
The incident occurred on a Sunday morning during transport from the special police station at Bahnhofquai to the detention section of the criminal police building. The victim had his hands bound behind his back. According to the indictment, the man was never aggressive at any point and behaved cooperatively.
Inside the building, the accused allegedly pushed the bound man's head against the wall two to three times. In addition, he struck him multiple times deliberately with his fist in the ribs and hit him with a shoe to the back of the head, according to the indictment.
The assaults continued in the cell: because the detainee could not immediately comply with an order to kneel due to a language barrier, the officer kicked him in the back of the knee. When the man crouched on the ground, the police officer delivered further kicks to his leg. The victim was unable to defend himself due to being bound.
The public prosecutor's office is requesting a conviction for abuse of office. It is seeking a suspended fine of 180 daily rates of 110 francs each with a probationary period of two years as well as an unconditional fine of 4,000 francs.
