Lawyer for Marcos Calarcá denies links to Uribe Turbay assassination

Calarcá's defence demands judicial backing before assigning responsibility in assassination

The lawyer Luis Eduardo de la Hoz López, legal representative of several leaders and former congressmen of the Comunes party—among them Luis Alberto Albán, known during the peace process as Marcos Calarcá—requested that the public accusations of María Claudia Tarazona be subjected to judicial verification before responsibilities are assigned. According to infobae.com, the lawyer made the statements in conversation with Blu Radio.

De la Hoz López, of the firm DLH Legal Group S.A.S., acknowledged the right of the widow of senator Miguel Uribe Turbay to demand justice and to have the facts clarified. However, he warned that accusations without a determination by the authorities can compromise due process.

"One thing is to investigate a complaint and quite another is to convert it prematurely into a public conviction," the lawyer declared. He noted that criminal responsibility in Colombia is individual and must be established with legally obtained evidence and through a decision by the competent judicial authority.

Formal request to the Office of the Prosecutor General and direct denial

The legal representation reported that it requested the Office of the Prosecutor General of the Nation the formal transfer of the chats and other probative elements to which Tarazona referred, in order to examine them within the corresponding process. The representative questioned that his clients should be pointed out before those materials are incorporated and assessed by the accusing body.

"Pointing out without the evidence that is within the Office of the Prosecutor General and accusing our group of clients is irresponsible," De la Hoz López stated to the radio station. The firm indicated that it filed the powers of attorney with the prosecutor's office and expressed willingness to respond to any requirement of the investigation.

When directly asked about the situation of Luis Alberto Albán, the lawyer was categorical: "He has nothing to do with that assassination." He added that Albán remains in the country and fulfils the commitments arising from the Peace Agreement before the Special Jurisdiction for Peace (JEP).

Legal actions in preparation against the accusations

The former congressmen of the Comunes party are preparing legal actions before the Office of the Prosecutor General of the Nation following the accusations by Tarazona, who claimed to have received messages about the possible perpetrators of the attack that cost the life of the senator and presidential candidate.

The defence rejected that its clients should be linked with criminal activities on the basis of coincidences of names, old aliases, political associations or content whose authenticity has not been verified. The statement was signed by De la Hoz López on behalf of the six former congressmen.

In a statement, the firm cited article 29 of the Political Constitution of 1991: "Every person is presumed innocent whilst no judicial decision establishing their responsibility exists." The defence maintained that the presumption of innocence prevents assigning collective criminal responsibilities or declaring guilt on the basis of statements made public.

The evidentiary value of the materials, in question

DLH Legal Group S.A.S. questioned the evidentiary value of the materials which, according to Tarazona, contained names and photographs of persons supposedly related to the organisation of the attack. The firm stated: "A photograph, a conversation attributed to third parties or the mention of a name does not constitute, in itself, proof of authorship, determination or participation in a homicide."

The Office of the Prosecutor General is conducting judicial police work to determine the origin and authenticity of an email that Tarazona sent to the body on 3 September 2026. The message contained information linked to the alleged planning of the assassination of senator Uribe Turbay.
