Two years since Hilsaca Eljadue's acquittal: Court closed proceedings without conviction

According to tsmnoticias.com, on 9 October 2024 the Criminal Chamber of the Bogotá Superior Court confirmed the acquittal of Cartagena businessman Alfonso del Cristo Hilsaca Eljadue, concluding that the Prosecution "failed to demonstrate the responsibility of the defendant in any offence".

Today marks two years since that decision, with which the Court closed the criminal proceedings against Hilsaca Eljadue in the second instance.

The accusation comprised three offences. For two of them—one of an economic nature and another against life—the 7th Criminal Court of the Specialized Circuit of Bogotá had issued an acquittal on 26 August 2024. The Court confirmed that acquittal in the second instance.

The third charge, conspiracy to commit a crime, did not reach a substantive decision: the court ruled that criminal proceedings had been barred by the passage of time. Nevertheless, the Court expressly included that offence in its analysis and concluded that the Prosecution likewise failed to demonstrate the defendant's responsibility on that point: "whether aggravated conspiracy to commit a crime, financing of criminal organisations, apart from aggravated homicide", wrote the Chamber in the judgement.

After reviewing the evidence across more than twenty pages, the Chamber synthesised its position in unequivocal terms: "It is not possible to establish, as the prosecution maintains […] the responsibility of the defendant in any of the offences for which he was prosecuted".

The decision became final upon no appeal by extraordinary means of cassation being filed. The judgements of both instances are available in the documentary repository of the press office.
