A guard from a prison in the Karlovy Vary region attacked an inmate with a taser while the prisoner was feigning illness. The regional court in Plzeň imposed a two-year suspended prison sentence for cruel treatment.

The Plzeň regional court has sentenced Jiří Kubík, a former guard from the Vykmanovy prison in the Karlovy Vary region, to two years in prison with a suspended sentence. The sixty-six-year-old man repeatedly used an electric stun gun against an inmate in October 2023 who was feigning health problems. In addition to four shocks to the chest, he also struck the prisoner in the groin.
The incident occurred when the convicted man was simulating illness and loss of consciousness to avoid being placed in a closed ward. According to the charges, Kubík applied the taser to the inmate's chest four times for approximately five seconds each and struck his genitals at least once.
"The accused posed no danger. He showed no aggression and was of slight build. Furthermore, the guard had been trained that this type of stun gun must not be used on the genitals," said the presiding judge Pravoslav Polák. Although Kubík did not cause the inmate serious health consequences, he caused him severe pain in the genital area, thereby subjecting him to physical and mental suffering.
The court described the guard's conduct as cruel and inhuman, which constituted an impermissible infringement of the victim's personality rights and dignity. The verdict is final. Kubík defended himself by claiming he was only sparking the taser in the air to wake the inmate.
In connection with the case, the district court in Karlovy Vary imposed conditions on three other guards who witnessed the attack without intervening. However, the regional court overturned this verdict and returned the matter for reconsideration.
