Brother in southern Moravia sexually abused minor sister for years, sentenced to four years

The Court of Appeal in Olomouc on Thursday upheld a four-year prison sentence for a now 26-year-old man. In a flat in southern Moravia, between mid-2015 and 2019, he repeatedly sexually abused his sister, who was between nine and twelve years old at the time. In one instance, he raped her under threat of harm to her health.

The accused defended himself by saying he was still a minor when he started committing the crimes, was not intellectually mature, and had impaired self-control. However, the chair of the panel, Daniel Plšek, rejected these arguments. "Over a long period, the accused committed approximately 150 cases of sexual offences against his minor sister. These comprised three criminal acts in total. There are also consequences of his actions. His previously clean record and confession of guilt cannot outweigh this," said Plšek.

The young man groped his sister and forced her to engage in various sexual practices against her will. He threatened to publish photographs of her in compromising situations, which he himself had taken.

The girl developed psychological problems and confided in people around her. The matter subsequently came to the attention of the police. The victim suffers from post-traumatic stress disorder, which manifests in nightmares and difficulties in forming relationships.

The case was heard by the Regional Court in Brno twice. The Court of Appeal first quashed it and ordered additional evidence to be gathered. On 26 March this year, the Regional Court again imposed a four-year sentence. The accused appealed and demanded a shorter, suspended sentence. The Court of Appeal rejected his request and upheld the original judgment.
