A middle-aged man who posed as a paramedic and police officer has been remanded in custody. He is alleged to have raped a fourteen-year-old schoolboy and attempted to gain his guardianship. The Constitutional Court rejected his complaint against the remand.

The Czech-Lipsk district court has remanded a middle-aged man into custody who posed as a paramedic or police officer to gain access to underage boys. According to the indictment, he raped a fourteen-year-old schoolboy and sought to place him under his guardianship. For this purpose, he made contact with the boy at school and at a doctor's surgery, and used deception to gain access to a summer camp to remain close to his victim.
The perpetrator had previously been convicted of child sexual abuse. An expert assessment produced after his arrest found him to exhibit homosexual paedophilia and rated him as dangerous to society without treatment. If found guilty, he faces up to fifteen years' imprisonment.
The accused contested his remand by filing a constitutional complaint. He claimed that the victim had changed his statement and lied about his actual age. He further argued that after his release he would live with his mother and work, and denied that courts should consider his previous conviction.
However, the Constitutional Court rejected the complaint. The reporting judge Michal Bartoň stated that the detention instances had concluded that the act was committed and bore the hallmarks of criminal offences. According to the ruling, consideration of the previous conviction was not disproportionate, as it was reinforced by a new expert assessment confirming that the perpetrator's erotic orientation towards child and adolescent male objects substantially reduces his capacity to control his behaviour.
