A 53-year-old man who worked as a refuse collection truck driver has been released from serving his sentence. Jaroslav Eberle had been serving a one-year sentence since last December for repeatedly raping his colleague. The Karlovy Vary court decided to grant conditional release based on a positive assessment of his behaviour whilst imprisoned.
Judge Jaroslava Krůšková stated that the convicted man had fulfilled all legal requirements. Eberle is now subject to a three-year probationary period and will be under supervision of a probation officer. He spent a total of seven months in prison.
According to court documents, the attacks occurred during January 2024 in the cab of a lorry. The perpetrator forced sexual contact from his colleague, who was physically unable to defend himself effectively. State prosecutor Marcela Šímová described how the accused exploited his physical superiority. The driver would take detours to remote forest roads, where he would beat his colleague, pull him by the ears and force him to engage in various sexual acts.
Victim Miroslav Dubský testified that at their first encounter, Eberle told him that he liked his physique. Gradually he began pressuring and assaulting him. Paradoxically, Dubský is now serving a nine-year sentence for the rape of two women in Plzeň, which he committed shortly after the incidents with Eberle. Experts before the court then pointed out that victims of sexual violence can in some cases themselves become perpetrators.
