The regional court in Plzeň has overturned a decision by Tachov district court to conditionally discontinue proceedings against a Ukrainian man who aggressively attacked a city guard in Tachov last summer.

The Plzeň regional court reversed the decision of Tachov district court, which had suspended proceedings against the sixty-nine-year-old foreigner. The man now faces renewed criminal proceedings. Details are not yet available as the written verdict has not yet been delivered to all parties, said court panel chairman Radoslav Krůšek.
Everything took place in July of last year on Tachov's Třída Míru (Peace Avenue). A city police patrol stopped the driver of a Lexus vehicle for not wearing a seatbelt. The foreigner immediately began shouting at one of the guards that he was causing him problems repeatedly in a short period of time.
The driver's behaviour deteriorated sharply during the check. For approximately thirty minutes, he yelled that he would publicise the entire matter through the head of state, that the uniformed man would lose his job and end up behind bars. He claimed he had achieved the rank of major general in his homeland. Only after half an hour did he sign the infringement notice and accept the fine.
The original judge, Michaela Řezníčková, suspended the case conditionally. The accused was to pay thirty thousand crowns to charitable purposes and observe a two-year probation period. In her reasoning, she stated that the person in question had previously lived without a record in the registry, showed remorse and apologised. She added that the attacked guard himself did not file a criminal complaint and did not want the matter resolved in court.
However, the state prosecutor filed an appeal. According to him, it was a case of prolonged verbal aggression in which the accused continuously made threats of retaliation. He argued that such a lenient approach could give citizens the impression that foreign perpetrators are not punished in the same way as others.
Witnesses from the vicinity called state police to the incident. Employees of the labour office who observed the scene from windows reported that an attack on a public official was taking place.
