A 45-year-old man was convicted before the Starnberg district court of assault and intimidation of his former wife and sentenced to a fine.

Before the Starnberg district court stood a 45-year-old man who had confronted his divorced wife in November of last year in the Würmtal. The proceedings ended with a fine of 80 daily rates of 30 euros each, amounting to 2,400 euros.
The man had driven to his former partner's home to obtain copies of identity documents for their shared children. The woman had refused this the day before because the man's payments were outstanding. The situation escalated physically at the front door.
According to the prosecution, the man insulted and attacked his ex-partner. He is said to have spat on her, butted her with his head and grabbed her by the arm. When the woman loudly cried for help and used her mobile telephone to document the incident, the perpetrator released her. He returned to his vehicle and made a movement around his neck that was interpreted as a threat.
The defendant, who had already left the shared flat before the incident and had no previous convictions, disputed the allegations. He stated that he had merely held the woman because she had resisted. Violence was unthinkable for him, he claimed.
That same day, the victim filed a report with police in Gauting and obtained a contact ban for two weeks, which the man complied with. In court, the 42-year-old also described earlier incidents during the marriage: beatings, destruction of personal belongings and coercion to perform household duties.
A neighbour was called as a witness. She reported having perceived the argument as threatening. The woman had seemed extremely distressed. She had perceived the spitting acoustically, not visually. She did not notice the gesture around the neck.
The presiding judge advised the defendant to drop his objection to the penal order and offered a reduction in the daily rate owing to financial difficulties. The prosecution also saw no prospects of an acquittal. The man did not enter a guilty plea but ultimately accepted the conviction.
