Plastic surgeon arrested in National District to serve sentence for involuntary manslaughter
The Public Prosecutor's Office apprehended doctor José del Carmen Desena Montero, who was sentenced to one year in prison for the death of a patient. The suspension of his sentence was revoked for failure to comply with the imposed conditions.
Plastic surgeon sentenced in patient's death arrested in National District
The Public Prosecutor's Office detained plastic surgeon José del Carmen Desena Montero in the National District, according to reporting by remolacha.net. The doctor must serve a one-year prison sentence for involuntary manslaughter in connection with the death of a patient, a sentence that has become final and binding.
The Unit for the Capture of Fugitives, Rebels and Sentenced Offenders (Ucaprec), headed by prosecutor Andry De Los Santos, executed the arrest warrant authorised under Resolution 249-01-2026-SAUT-00631, issued by substitute judge Emely Milagros Bruno Almonte of the Sentencing Execution Court of the National District.
Desena Montero will serve his sentence at the Najayo Men's Correction and Rehabilitation Centre (CCR-XVII), located in San Cristóbal province.
Suspended sentence revoked for non-compliance
The Eighth Chamber of the Criminal Court of the Court of First Instance of the National District originally issued Judgment number 046-2025-SSEN-00145 on 17 September 2025, in which it sentenced the doctor to one year suspended imprisonment for violating article 319 of the former Penal Code, which penalises involuntary manslaughter.
The Sentencing Execution Court of the National District subsequently revoked that suspension through Resolution number 249-01-2026-SRES00615, dated 18 June 2026, upon finding that Desena Montero had failed to comply with the rules of conduct imposed during the period of the sentence.
Among the conditions that the doctor failed to observe were: residing at the address declared to the court, refraining from excessive consumption of alcoholic beverages, not carrying or possessing weapons, attending three talks coordinated by the Judge of Sentencing Execution, and paying a fine of one hundred pesos (RD$100.00) to the State.
