Santiago court condemns mother to 20 years for torture and abuse against her minor children

A panel court in Santiago has sentenced a woman to 20 years in prison for committing acts of torture and physical and psychological abuse against her children aged 3 and 5 years old, according to reporting by elnuevodiario.com.do.

The judges of the Fourth Panel Court of Santiago, Rubén Darío Cruz Uceta, Rubén Rodríguez and Yasmín de los Santos, issued the sentencing ruling after accepting the evidence presented by litigating prosecutor Jenniffer Rodríguez. The name of the convicted woman is omitted to protect the identity of the victims.

The mother was found guilty of multiple physical and psychological abuses against her children, whom she also threatened with death. The evidence gathered by investigating prosecutor Leomaris Payamps, from the Integrated Care Unit for Victims of Gender Violence, Domestic Violence and Sexual Offences, made it possible to demonstrate the profile of the aggressor and her unlawful conduct.

After analysing the material, documentary, testimonial and expert evidence, the judges upheld the petition of the Santiago Prosecutor's Office and ordered that the woman serve the 20 years of deprivation of liberty at the Correction and Rehabilitation Centre (CCR) of Rafey Women, in the province of Santiago.

The sentencing ruling was issued for the violation of articles 309-2, 303-3 and 303-4, numerals 1 and 4, of the Dominican Penal Code, as amended by Law 24-97 on Gender Violence, as well as articles 396 (A and B) and 397 of Law 136-03, which creates the Code for the System of Protection and Fundamental Rights of Children and Adolescents.

The facts took place in a neighbourhood in the north of the municipality of Santiago de los Caballeros and date back to 2023. During that period, the now-convicted woman sent text messages to her ex-partner in which she threatened to take the life of their common daughter, who at that time was 2 years old.

The defendant also sent recordings in which she is seen brutally striking the child on the head, face and various parts of the body, as well as attempting to suffocate her with her hands. Additionally, she burned the child on one of her legs with a match, an act which she carried out in the presence of her other son, aged 5 years old.
