Driver arrested in Hoyos for fatal accident in Villamiel: no licence and drunk

New arrest of driver involved in Villamiel fatal accident
The Guardia Civil has re-arrested the 38-year-old driver responsible for the fatal accident recorded in Villamiel in early August, according to hoy.es. The man was arrested on Tuesday 25th in Hoyos, a locality in the province of Cáceres, whilst driving with his licence suspended by court order and under the influence of alcohol.
Vehicle with visible irregularities
A patrol on duty detected the vehicle after checking that it presented evident deficiencies: it lacked a rear-view mirror and had a broken windscreen. Upon stopping it, the officers verified that the driver had his right to drive motor vehicles judicially suspended by order of an Court of First Instance.
During the intervention, the officers observed clear signs of alcohol consumption. The offence of driving under the influence of alcoholic beverages was attributed to the detainee as a consequence of that finding.
Refusal to take breath tests
Already at Guardia Civil premises, and before the Road Accident Investigation Team (EIS) of the Traffic Sub-sector of Cáceres, headquartered in Plasencia, the arrestee refused to undergo alcohol detection tests. That refusal constitutes an autonomous offence in accordance with current legislation.
The EIS assumed the investigation of proceedings for three offences: driving under the influence of alcohol, refusal to take breath tests, and driving with a licence suspended by final judgment. Once police proceedings concluded, the records were sent to the judicial authority, which ordered the detainee's remand in provisional detention.
Background: the fatal accident in Villamiel
This is the same individual arrested in early August for his alleged involvement in a fatal road accident in Villamiel, in which a 51-year-old motorcyclist lost his life. After hitting the motorcycle on the EX-205, the driver fled the scene.
For that accident, the man could face several criminal charges. Article 195 of the Criminal Code classifies the omission of the duty to render assistance with sentences of three months to four years. Article 142.1 punishes homicide through gross negligence with imprisonment of one to four years and deprivation of the right to drive for one to six years. Article 379.2, relating to driving under the influence of alcohol, provides for sentences of three to six months' imprisonment and suspension of the licence for one to four years.
