Trial for rape of housemate in Puertollano: Public Prosecutor's Office seeks ten years
The Provincial Audience of Ciudad Real will hold the trial on 9 and 10 September against J.C.S., a 67-year-old man accused of sexual assault, specifically rape, against a particularly vulnerable person. According to ABC, the Public Prosecutor's Office is requesting ten years' imprisonment for the accused for the events that occurred in Puertollano on 7 May 2022.
The accused and the victim, a 22-year-old woman identified as B., shared rented accommodation in the town. According to the Public Prosecutor's Office accusation, the relationship between them was merely one of cordial cohabitation, with no closer personal bond.
The facts: alcohol, freezing and recording as evidence
At 13:00 hours on the day in question, J.C.S. encountered B. in a bar, sat at her table and invited her to two beers. Later they moved to another establishment, where the young woman began to feel unwell and vomited in the toilet. The proprietor of the venue then asked the accused to accompany her home so she could recover.
J.C.S. took her to the shared residence at around 18:00 hours. Once there, B. lay down on her bed and fell asleep. Upon waking, according to the account recorded by the Public Prosecutor's Office, she saw the defendant at the foot of the bed. They smoked a cigarette together and, suddenly, the man kissed her, causing the young woman to freeze.
The Public Prosecutor's Office maintains that the accused took advantage of B.'s lack of reaction, prompted both by fear and by the alcohol she had consumed, to sexually assault her. During the assault, the victim picked up her mobile phone and began to film what was happening, sending the video to a friend identified as C. She also sent her several messages asking for help.
At a certain point, B. refused to continue and broke down in tears. According to the accusation, the defendant then desisted, coinciding with the moment when the doorbell rang: C. and her partner had come to the residence to help the young woman.
Restraining order request and waiver of compensation
In addition to the prison sentence, the Public Prosecutor's Office is requesting that J.C.S. be prohibited from approaching B. closer than 500 metres or communicating with her for a period exceeding the length of imprisonment ultimately imposed by five years.
The victim has waived the financial compensation that might be due to her.
