The Court of Cassation annulled on Friday 12 June the decision that had ruled out the charge of murder for the police officer responsible for the fatal shot against Nahel Merzouk. This judicial decision represents a turning point in the proceedings, as it makes it possible once again to consider a trial for voluntary homicide.
The case had initially been referred to a criminal court for "violence resulting in death without intention to cause it", a lighter charge than murder. France's highest court of law ruled that this reclassification did not withstand scrutiny and quashed the ruling of the Versailles court of appeal.
The matter dates back to 27 June 2023, when a 17-year-old adolescent, Nahel Merzouk, was killed by a police shot during a traffic stop in Nanterre. This death had provoked riots in several cities across France.
The police officer in question, Florian M., will now have to be tried again. The case will be re-examined by a court of appeal, which will have to rule on the exact classification of the facts. This new decision may itself be subject to further appeals.
