Court of Appeal eases Marine Le Pen's sentence, opening door to 2027

The Paris Court of Appeal confirmed on Tuesday 7 July Marine Le Pen's guilt in the matter of parliamentary assistants for the National Front (FN) at the European Parliament, while imposing a sentence significantly lighter than that of the first-instance judgment. According to France Info, which consulted the 341-page ruling, the three judges notably reduced the duration of ineligibility, making the National Rally (RN) leader eligible for the 2027 presidential election.

From four years to three years in prison

On 31 March 2025, the criminal court had sentenced Marine Le Pen to four years in prison, two of which are custodial, a fine of 100,000 euros, and five years of ineligibility to be served immediately. On appeal, the prison sentence is reduced to three years, one of which is custodial and can be served in the form of electronic monitoring. The fine remains set at 100,000 euros.

The ineligibility sentence, meanwhile, is reduced to 45 months, of which 30 months are suspended. The court considers that the 15 months of effective ineligibility, running from 31 March 2025, have been served since 1 July. Marine Le Pen is therefore now eligible.

Court invokes integrity already repaired

To justify this reduction, the Court of Appeal argues that "the execution of this sentence since 31 March 2025 has already repaired the breach of integrity to a degree compatible with the fundamental guarantees recognised to the citizen". It emphasises that "to ignore" this already-served period "would infringe the principle of freedom of candidature, an essential condition for a democratic expression of universal suffrage".

The court also notes that at the time of the facts, sentences of ineligibility were not mandatory, leaving it discretion over "the sanction" to impose.

A system of misappropriation over eleven years

On the merits, the court maintains in full Marine Le Pen's guilt. She is found guilty of complicity in the misappropriation of public funds committed by the National Front party as a legal entity, of which she assumed the presidency in 2011 following her father Jean-Marie Le Pen.

The ruling emphasises that "the practices of misappropriation of funds persisted for more than 11 years, under the decisive impulsion of Jean-Marie Le Pen, historical leader of the party, and of Marine Le Pen, who succeeded him, with the active participation of the treasurer, the third-party payer and the MEPs who adhered in numbers to the scheme". The total amount misappropriated exceeds 2.8 million euros, funds allocated by the European Parliament that were used "for purposes other than those for which they were intended".

The court notes that these misappropriations "caused a breach of equality with other political parties" and were committed "by elected officials, responsible for the general interest and of whom complete integrity is expected".

Mitigating circumstances taken into account

For the reduction of the prison sentence, the judges state that they "took into account the fact that Marine Le Pen did not derive any personal enrichment from these offences committed for the benefit of the party she chaired". They also take into account "the now-ancient breach of integrity and the absence of reiteration of criminal behaviour over nearly a decade".

For ineligibility, the court takes account of "the age of the facts, the absence of personal enrichment and the absence of reiteration of any criminal behaviour since then".

The ruling nonetheless emphasises that "her behaviour has necessarily damaged the confidence of citizens in political parties, the proper functioning of the electoral system and the democratic process, and raises questions about her capacity to exercise elective office and to respect all its duties, the first of which is respect for the law".

Le Pen announces 2027 candidacy and cassation appeal

A few hours after the ruling was announced, Marine Le Pen declared on TF1 her intention to be the National Rally candidate in the 2027 presidential election. She also announced her appeal to the Court of Cassation, wishing to "exhaust the means of remedy available to her" and stating that "there is no longer a scenario" in which she could not stand.

The RN leader will, however, have to conduct at least part of her campaign whilst wearing an electronic monitoring bracelet, a consequence of the one year of custodial imprisonment that can be served in this manner imposed by the Court of Appeal.
