Tempi Trial: Defence lawyers seek adjournment and nullity objections
The Three-Member Court of Appeals for Felonies in Larissa is examining legal challenges that will determine the course of the trial over the Tempi tragedy. The defence lawyers for 16 accused ERGOSE officials submitted requests that could significantly slow down the proceedings.
According to information from Newsbeast, the defence counsel requested that the trial be suspended until the case investigated by the European Public Prosecutor's Office is first completed. They argue that their clients were also charged by the European authority, but their cases were archived. This, according to them, creates res judicata that affects the Greek trial.
In parallel, objections were filed for the nullity of the indictment. The lawyers invoke a provision of the Code of Criminal Procedure that prohibits double prosecution for the same act when a final decision has already been issued.
The 16 accused are former and current ERGOSE officials, including engineers, chairmen and chief executive officers who served at the company from 2016 to 2023. All face felony charges for disruption of railway transport safety.
The court is now called upon to rule on the proposals submitted, with the next hearing scheduled for the coming Wednesday. At that time, defence counsel are expected to present their arguments, objections and independent submissions.
