Split Municipal State Attorney's Office has filed charges against a man accused of enabling his niece's cocaine consumption and committing a sexual act against her without her consent.

The State Attorney's Office in Split has filed charges against a man for allegedly giving cocaine to his own niece and sexually assaulting her. The case has been placed on the court register of the Municipal Court in Split, and the prosecutor has requested a conviction and a prison sentence of 14 months.
According to the charges, the incident occurred on 12 February of this year in one of the municipalities of the Split-Dalmatia County. It took place in a space opposite the family house. The defendant allegedly prepared cocaine, a substance listed on the official register of illegal drugs, and offered it to the girl. After she took it, the man committed a sexual act against her without her consent whilst they were alone.
A month later, on 12 March, the same man sent a cryptic message to his niece via WhatsApp. In it, he threatened to physically assault her stepfather if she did not massage him next time. According to the same allegations, on the same day he delivered a bag of cocaine to the victim through a third party.
During questioning before the prosecutor, the defendant rejected all charges. He claimed that family relations with the victim's house were not good and that the allegations were fabricated. He stressed that he had been with his niece very briefly, that he had not touched her nor offered her drugs. He also denied ever sending the disputed message.
The prosecution nonetheless believes there is sufficient evidence. It relies on the statement of the injured party which, in their assessment, is credible, detailed and supported by circumstances. They also note that there was no bad relationship between the victim and the defendant, so there is no motive for false accusation.
For the criminal offence of enabling drug use, a sentence of nine months' imprisonment has been requested, and for the sexual act eight months. These two sentences should be combined into a single sentence of one year and two months.
