Based on a statement from the Metropolitan Chief Prosecutor's Office on Thursday, the Interior Ministry's Wednesday claim that the investigating authority had jointly carried out all substantial procedural measures with the prosecutor's office does not correspond to the truth – reports 444.hu.
The ministry stated Wednesday evening that the police had carried out the substantive procedural measures "in coordination with the prosecutor's office". However, the prosecution now claims that the Riot Police National Investigation Office informed them in writing on 3 July of the commencement of the investigation, and then by telephone on 7 July that they were conducting a search and questioning the man as a suspect. These were not consultations, but merely notifications.
According to the chief prosecutor's statement, the competent prosecutor verbally warned the investigators to carefully examine whether the conduct actually met the applicable provisions of the Criminal Code. In response to press reports, they requested a detailed report, which revealed that the search had been conducted, the man had been questioned, but he was not taken into custody. The suspect filed a complaint.
Under the applicable procedural rules, the police act independently during the investigative phase of an investigation and decide on their own authority regarding the substantiation of suspicion, without prosecutorial approval. The chief prosecutor's office emphasised that no such authorisation occurred in this case. The complaint and documents were received by the prosecution on Thursday morning, which will inform the public of the outcome of the review at a later date.
