Drug-impaired driver arrested after causing fatal accident on Soroksári Road

On Saturday, the Budapest Central District Court ordered the detention of a 34-year-old man who caused a fatal traffic accident in Budapest's ninth district two days earlier, according to Google News HU — Crime.

The accident occurred on Thursday morning at around six o'clock. The suspect changed lanes from the inner lane of Soroksári Road into the lane of oncoming traffic, then collided with a private car travelling in the outer traffic lane. As a result of the impact, the other vehicle struck the roadside barrier and a column obstructing parking. The driver lost his life at the scene; his passenger was taken to hospital with serious injuries.

A drugs rapid test performed on the suspect at the scene returned a positive result. The investigative authority subsequently informed him of the well-founded suspicion of the crime of driving a motor vehicle while impaired, causing death. According to a court statement, the suspicion is also supported by the scene inspection minutes, site plan, photographs, and post-mortem examination documents.

According to the court's findings, the offence is punishable by imprisonment ranging from two to eight years. The severity of the sentence that could be imposed is in itself considered a factor increasing the risk of flight and concealment, which justifies preventive detention.

In its decision, the court also referred to the fact that the man had previously been convicted of offences related to drug possession, and based on the rapid test results performed at his arrest, it can be concluded that he engages in sustained drug use. This indicates a low level of willingness to comply with norms of his own accord.

The court emphasised that the suspect was not deterred from committing another offence by either previous convictions, parallel criminal proceedings, or other coercive measures. More than four months after the expiry of the man's conditional release, and a week after the alleged cessation of a coercive measure applied in a procedure currently ongoing, he again became a suspect.

"The suspect is deliberately in conflict with the law and traffic regulations, and through this conduct poses an increased danger to the lives and physical integrity of other persons participating in traffic," the court stated.

According to the court, detention is the only measure that can substantially prevent the commission of further offences punishable by imprisonment. The ruling is not final: the suspect and his counsel have appealed.
