Lawyer Mario Ventimiglia, who is defending the biological father of Beatrice, the two-year-old girl who died in Imperia, has requested a modification of the charge against Emanuel Iannuzzi. The man is currently accused, together with his partner Emanuela Aiello, of aggravated mistreatment resulting in the death of the child. The lawyer believes that voluntary manslaughter should be charged.
"Striking a creature of just twenty-four months old is not comparable to an assault against an adult," Ventimiglia stated, adding that "the brutality and cruelty with which the girl was beaten make it impossible to maintain that the perpetrator was not aware of the lethal consequences". The lawyer expressed confidence that the prosecution could amend the charge on the basis of further evidence that will need to be submitted.
The biological father, represented by Ventimiglia together with colleague Fabio Scaffidi Fonti, is waiting for the mother to "finally tell the truth about what caused the death of her daughter". The man expects that the judicial authorities will shed full light on the matter.
From the Imperia public prosecutor's office it emerges that the current charge is provisional. The investigators have explained that, at the precautionary measure stage, it was necessary to identify a clear-cut offence in order to obtain the arrest in quick time. Mistreatment met this requirement, whereas for aggravated manslaughter it would have been essential to identify with certainty the actual perpetrator. The charge could, however, be aggravated in subsequent phases of the investigation.
Meanwhile, Emanuela Aiello has undergone a guarantees hearing. The woman, who was crying during the hearing, denied ever mistreating her daughters. The hearing was interrupted by the judge after twenty minutes due to an emotional crisis. The order confirmed custody in prison for both her and her partner Iannuzzi, who instead chose to exercise his right not to respond.
The magistrate who signed the arrest order highlighted a message sent by Aiello to her mother-in-law during the night of 16 to 17 January. That evening, according to the prosecution, Iannuzzi had struck Beatrice with slaps causing her to fall to the ground before the parents' arrival, and subsequently had also attacked his partner. In the text the woman wrote that she was willing to "throw herself under a train" for her partner, adding that certain situations "as a mother I cannot witness". According to the investigators, something "worrying" happened to one of the daughters that night.
