Judges of the fifth criminal section of the court at Piazza Cavour have made public the reasoning behind the decision taken last March on obstruction of justice linked to the disappearance of Stefano Cucchi. The Roman surveyor died on 22 October 2009, a week after being arrested for possession of narcotics.
In the documents filed, it is argued that the false statements attributed to various members of the Carabinieri had been made in order to "conceal any possible responsibilities of the Carabinieri belonging to the 'Rome Group'" in the young man's death. On 5 March last, the Supreme Court had acquitted Colonel Lorenzo Sabatino, whilst it had rejected the appeals filed by the other defendants.
For General Alessandro Casarsa, Luciano Soligo and Francesco Cavallo, the statute of limitations for the offence had been recognised at the appellate level or the conviction had been upheld. The decisions on these latter individuals became final with the rejection of the respective appeals.
