Garlasco case, Sempio defence team: "Psychiatric evaluation pointless without established pathology"

The lawyers for Andrea Sempio contest the psychiatric consultation ordered by Pavia's prosecution: without a pathology, it will have no procedural relevance.

Psychiatric evaluation on Sempio, defence lawyers: "Without pathology it counts for nothing"

The psychiatric consultation ordered by Pavia's prosecution into Andrea Sempio, sole suspect in the new investigation into Chiara Poggi's killing in Garlasco on 13 August 2007, risks proving "pointless if no pathology is found". This is the assertion, according to ANSA Cronaca reports, of lawyer Liborio Cataliotti, one of Sempio's defence counsels, in an interview published in La Provincia Pavese.

"The consultant will not be able to limit himself to a personality assessment, on which our legal code does not permit establishing anyone's guilt", Cataliotti argues. The evaluation, assigned to expert Roberto Catanesi, is expected to be filed in the coming days. The prosecution requested it to determine the suspect's capacity to understand and want and their social dangerousness.

Sempio has not made himself available to undergo the examination directly: Catanesi will therefore have to base his assessment on the suspect's writings and monologues intercepted whilst the man was in his car.

The lawyer recalls the precedent of the Cogne murder case, in which the suspect Annamaria Franzoni refused the examination and the report was not admitted in the trial. "Catanesi will have to identify a pathology, otherwise the consultation will have no relevance for any eventual trial", Cataliotti concludes.
