Court of Cassation: Impagnatiello planned murder of Giulia months in advance
The reasons for the ruling by which the Court of Cassation ordered a new appeal trial in the case of the murder of Giulia Tramontano have been made public. The woman, seven months pregnant, lost her life on 27 May 2023 at the hands of her partner Alessandro Impagnatiello, already sentenced to life imprisonment definitively for the murder.
The Supreme Court believes that the killer had formed the intention to kill the victim long before the day of the crime. In particular, the judges emphasise that the second-instance court had not adequately considered the progressive increase in the use of rodent poison that began as far back as December 2022, with a sharp rise in the weeks immediately preceding the fact.
Another element highlighted by the supreme judges concerns the moment when the murderous decision became concrete: according to the Court of Cassation, even in the hours immediately preceding the killing, the will to commit the act was already present.
On 9 April the Fifth Criminal Division accepted the appeal by the Prosecutor's Office and referred the matter to a new appeal panel, which must now re-examine the question of premeditation, initially excluded but now reopened.
