Million-euro compensation for Martina Rossi's parents
The civil court in Arezzo has ordered Alessandro Albertoni and Luca Vanneschi to pay over one million euros to the parents of Martina Rossi, the Genoese student who fell from the balcony of a hotel in Palma de Mallorca on 3 August 2011, aged twenty, while attempting to escape a sexual assault. ANSA Cronaca reports this, citing the Corriere di Arezzo.
The judgment by civil judge Fabrizio Pieschi, filed on Tuesday, apportions the compensation as follows: €489,836 to mother Franca Murialdo, €457,563 to father Bruno Rossi, and a further €74,531 to be paid jointly to both parents for property damages and for the attempted assault.
Albertoni and Vanneschi had been definitively sentenced to three years' imprisonment for attempted sexual assault. In civil proceedings, Judge Pieschi established their responsibility for Martina's death by applying the criterion of "balance of probabilities", ruling out any contributory fault on the part of the victim. The offence of "death as a consequence of another crime" had been declared time-barred in the criminal proceedings.
The judgment is immediately enforceable, but the lawyers for the two convicted men — who have always denied the accusations — may appeal it and request suspension of its enforcement.
"This judgment is the natural consequence of the criminal conviction," father Bruno Rossi stated. "So far Albertoni and Vanneschi have never come forward, have never apologised and have deposited only one thousand euros into a dedicated fund. But our suffering never ends."
