The incident occurred during the night of 15 to 16 August, in the vicinity of the Hollywood nightclub on Corso Como, in Milan. The man was detained in the afternoon of Monday 24 August in Busto Garolfo, in the Upper Milan area, where he resides.

The precautionary measure was ordered by the gip (judge for preliminary investigation) of Milan Giulia D'Antoni at the request of the prosecutor's office. In the order, the judge wrote that Hassan allegedly exploited the victim's "obvious state of intoxication", abusing her "condition of weakness" and wresting from her "a sick form of consent".

According to the investigators' reconstruction, the 38-year-old allegedly met the young woman — in the company of a friend — inside the venue. After consuming some drinks together, he allegedly forced her to follow him outside and, in an area sheltered by a dividing wall, sexually assaulted her.

The victim's account is corroborated by various elements: Hassan's social media profiles and those of a colleague of his, statements from witnesses present that night, images from surveillance cameras — which according to the gip show "obvious reluctance" on the part of the young woman to leave the venue — and a tattoo on the man's neck, which the student identified.

In the order, D'Antoni established that the young woman was in a condition of "obvious, undeniable, evident incapacity to give valid consent", and that Hassan acted with "an absence of modesty and inhibition", with "the sole intent of satisfying his sexual instinct". The victim herself had told investigators that the man "could not have failed to perceive her state of intoxication, given that she herself had difficulty even expressing herself with coherent sentences".

The judge found concrete the risk that the crime could be repeated: Hassan regularly frequents nighttime venues and, in his role as an organiser of evenings and events, has the opportunity to come into contact with many young women. On this basis, the measure of house arrest was ordered.
