Turin: judge closes Elkann case, ruling no criminal liability for siblings
The Turin court has brought to an end the criminal proceedings involving Lapo and Ginevra Elkann. The magistrate has ordered the case to be archived for both of them, finding that the subjective element of the crime was absent. The Swiss notary Urs Robert Von Gruenigen has been acquitted on identical grounds, having been judged as a person unknowingly used by others.
The investigation concerned the question of the residence of Marella Caracciolo, the surviving wife of lawyer Gianni Agnelli. The legal proceedings had emerged during litigation initiated by John Elkann: the Supreme Court, last March, had declared inadmissible the appeal against the obligation to face trial. From that ruling, the approach had already emerged that led to the final decision of acquittal.
