The Public Prosecutor's Office of the State of Querétaro indicated that the woman was located outside Mexican territory through investigative measures and mechanisms of international cooperation. At the time of her detention, Colla had an active Migration Alert and Red Notice for her international location.

Peruvian authorities executed the arrest at the capital airport in response to the outstanding international request and the requirement of the Querétaro judicial authority. Colla's name had previously appeared in press reports linked to NXIVM, an organisation founded by Keith Raniere that operated through personal development programmes and had a presence in Mexico. In 2017, N+ Univision reported that Colla had been a student of Executive Success Programs (ESP), one of the programmes associated with that organisation. At that time, the actress spoke positively about her experience in those courses.

The Querétaro prosecutor's office did not indicate that the case for generic fraud is related to NXIVM. The reference to her participation in ESP corresponds to a background element of her public trajectory and does not in itself constitute a criminal charge within the investigation being conducted by the Querétaro authority.

International procedures are continuing their course to determine the eventual delivery of María Colla to the judicial authority that requires her in Querétaro, where the investigation for generic fraud remains active.
