Jhonsson Smith Cruz Torres, alias "Jhonsson Pulpo", received a sentence of 35 years of effective prison time for the crime of aggravated robbery resulting in death, according to elcomercio.pe. The victim was Santos Juliana Eustaquio, a 60-year-old merchant known as the "potato queen", whose murder occurred in Trujillo in 2020.
The crime occurred when Eustaquio was travelling with family members in a motorcycle taxi. Cruz Torres snatched money she was carrying in a backpack and shot her before fleeing the scene.
Security camera footage constituted one of the principal pieces of evidence linking the defendant to the crime. In the recordings, his face and movements were identified during the day of the attack. Other videos showed him hours later carrying the backpack taken from the victim and wearing the same clothes from the crime, whilst participating in what appeared to be a gathering inside a prison.
With these elements incorporated into the judicial process, Cruz Torres acknowledged his responsibility through the mechanism of early conclusion, a procedure that allows the defendant to admit the charges and close the trial under determined conditions. The Judicial Authority imposed a sentence of 35 years of effective prison time.
One of the aspects that raises questions is that "Jhonsson Pulpo" previously had a sentence of life imprisonment linked to the same facts. The application of early conclusion apparently allowed that sentence to be modified to 35 years in prison.
