The Regional Court in Łódź sentenced Ewelina P. on Monday to 13 years' imprisonment for attempted murder of her newborn daughter – according to wiadomosci.wp.pl. On 15 April 2025, the woman gave birth to a child in a derelict building in Bałuty, packed it in a plastic carrier bag tied with two knots and left it there unattended. The newborn survived only because a passing stranger entered the building and heard sounds coming from the bag.
Judge: she acted with direct intent to kill
The presiding judge, Marek Raszewski, had no doubts about the defendant's guilt. "The evidence indicates unequivocally that the defendant committed attempted murder with direct intent to deprive of life her newborn daughter Wiktoria, placed her body in a plastic carrier bag, tied the bag with two knots and left it in a derelict building on Zgierska Street," the judge stated when announcing the verdict.
Raszewski rejected the defence argument that the defendant was acting under the influence of stress and hormones. He emphasised that Ewelina P. had concealed her pregnancy throughout – even from her partner. According to witness testimony, it was the defendant who was the dominant person in the relationship, and her partner exerted no pressure on her.
Other circumstances allegedly testified to the lack of intent to raise the child. "She did not prepare any baby items, no clothes, nappies, cot, pram, nothing," the judge said. "When labour began, the defendant went to a shop, bought sanitary pads and went to a remote location, gave birth to the child outside a building, and then carried the child inside and hid it in the derelict building," Raszewski added.
Carrier bag tied so tightly that witness had to tear it open
The judge drew attention to a detail which, in his view, further confirmed murderous intent: the bag was tied so tightly that the passerby was unable to undo it. "The witness who found the child had no possibility of opening or untying those knots; he only had to tear open the carrier bag to see what was inside," the judge said. If the man had not entered the derelict building, the newborn would certainly have died.
The 13-year prison sentence was assessed by the court as appropriate to the degree of the defendant's guilt and the social harmfulness of the act. The crime of attempted murder carries a sentence of 10 to 30 years' imprisonment or life imprisonment.
Defendant admitted guilt but refused to provide explanations
Ewelina P. admitted her guilt in court, but refused to provide explanations. The court also ruled that she should be deprived of parental authority. The girl, who was named Wiktoria, was taken to hospital after being found and subsequently placed for adoption. According to the defendant's lawyer, Jerzy Ciesielski, the mother maintains contact with her two teenage daughters.
Ciesielski announced that after reviewing the written justification of the verdict, he would consider filing an appeal. He noted that 13 years is a sentence at the lower end of the statutory range provided for this offence.
