Public Prosecutor Opens Investigation Against MP Macierewicz Following AWS Incident

The District Public Prosecutor's Office in Warsaw opened an investigation on 23 September 2026 against Law and Justice MP Antoni Macierewicz — according to dorzeczy.pl. The case concerns events from 13 September 2026 at ul. Karmelickiej 9 in Warsaw, where Macierewicz allegedly threatened police officers on duty outside the building of the Academy of Judicial Studies.
The investigation is being conducted under Article 231 § 1 and Article 224 § 2 of the Penal Code in connection with Article 11 § 2 of the Penal Code. It concerns abuse of authority by a public official and the use of unlawful threats against officers with the aim of forcing them to abandon their official duties.
Threats Instead of Parliamentary Intervention
According to a statement from the prosecutor's office spokesperson, prosecutor Piotr Antoni Skiba, the District Public Prosecutor's Office in Warsaw received a notification on 14 September 2026 from the Minister of Internal Affairs and Administration. It indicated that Macierewicz threatened police officers with initiating criminal proceedings in order to force them to allow him to enter the premises.
The prosecutor's office established that the MP cited powers arising from parliamentary intervention as defined in Article 20 of the Act on the Mandate of an MP and Senator. However, the spokesperson emphasised that the direct purpose of entering the building was to deliver food, beverages and medication to an MP staying there — a purpose which, as the prosecutor's office indicated, "does not bear a functional connection with the powers provided for by parliamentary intervention".
Żurek: "Enough of the Theatre"
Waldemar Żurek, Minister of Justice and Prosecutor General, shared the prosecutor's office statement on the platform X, adding his own commentary.
"Mr Antoni Macierewicz, parliamentary intervention is not a courier service, and a Polish police officer on duty is not your private porter," Żurek wrote.
The minister assessed that Macierewicz "has become accustomed over the years to impunity and the conviction that a badge from Wiejska places you above the law". Żurek described the MP's behaviour as "ordinary political arrogance and lack of respect for the uniform".
"Blackmailing young police officers by 'settling criminal proceedings' simply because they would not let you in with a bag of provisions into the AWS building is not any sort of heroism," the minister wrote.
He concluded his post with the words: "Enough of the theatre. Time to answer for your actions".
Context
The prosecutor's office emphasised that Macierewicz's actions violated the public interest — the proper and undisturbed performance of statutory duties by police officers and the lawful functioning of the Academy of Judicial Studies. Żurek noted in his statement that with respect to the law, the MP is "exactly the same citizen as anyone you pass on the street".
