Dorel Săndesc, manager of Timișoara County Hospital, has secured the quashing of a 1 year and 8 month suspended sentence he received for death by negligence. The High Court accepted the transfer of the case to Oradea, and the previous sentence was annulled.

A sentence of one year and eight months' imprisonment with a suspended execution has been quashed for Dorel Săndesc, head of the county health unit in Timișoara. The decision was made by judges at the highest judicial authority in the country, who accepted the request to transfer the case from the local appeals court to the one in Oradea, according to G4Media.ro.
The incident which formed the basis of the case occurred seven years ago, when the clinician failed to yield at an intersection and struck another vehicle. A passenger in the struck vehicle died approximately three quarters of a year after the collision. Initially, the trial judges had sanctioned Săndesc for death by negligence.
The legal representative of the doctor, Adrian Fanu Moca, clarified that the supreme court had decided to transfer the case, which led to the annulment of the Timișoara judgment. The defence counsel criticised the manner in which the local appeals court had dealt with the appeal, considering that it had raised an exception regarding the expiration of a deadline in a manner lacking legal foundation. The case will be reopened from the beginning in the new court, because at the initial court no judgment was made on the substance of the dispute, but rather the case was dismissed on a procedural matter.
Although the offence could potentially be barred by the statute of limitations, his client does not wish to invoke this defence. His intention is for the judges to rule on the merits of the accusation, not to take advantage of the passage of time.
Săndesc heads the county hospital in Timișoara and also holds the position of vice-president of the professional society for anaesthesia and intensive care in Romania.
